Any replacement SOFTWARE will be warranted for the remainder of the original warranty period or 30 days, whichever is longer. This Limited Warranty is void if failure of the SOFTWARE has resulted from accident, abuse, or misapplication. The LICENSOR 's entire liability and the LICENSEE's exclusive remedy shall be, at the LICENSOR's option, either (a) return of the price paid or (b) repair or replacement of the SOFTWARE that does not meet LICENSOR's Limited Warranty. Upon termination you shall destroy all copies of the SOFTWARE.Ī) Except as specifically stated in this agreement, the SOFTWARE is provided and licensed 'AS IS' without warranty of any kind, either express or implied, including, but not limited to the implied warranties of merchantability and fitness for a particular purpose.ī) The LICENSOR does not warrant that the functions contained in the SOFTWARE will meet your requirements or that operation of the SOFTWARE will be either error free or appear precisely as described in the documentation.Ĭ) The LICENSOR warrants that the SOFTWARE will perform substantially in accordance with the accompanying documentation for a period of 90 days from the date of receipt by the LICENSEE.
